FAQ: Does the reason for my divorce affect how the financial settlement is worked out?

It is very rare that the reason for your divorce will affect the allocation of finances in a settlement. Generally, the welfare of any children involved takes priority in any financial settlement, regardless of bad behaviour or adultery by either spouse.

In extreme cases, such as violence that has had a lasting effect on the other partner, or if one partner deliberately tries to sabotage the joint financial position through reckless spending or destroying assets, for example, then this may be taken into account.
