There are a number of factors which determine whether an Islamic marriage is valid in the UK. If the couple have married legally in England and Wales as well as under Islamic law, then divorce proceedings under English law are required to dissolve the marriage. This legal requirement also stands if the couple has obtained a Sharia divorce.
However, it is often a misconception that a ‘nikah’ (Islamic contract of marriage) is valid and legally recognised in England and Wales without a legal civil ceremony. Unfortunately, in this case the marriage is not considered legally binding.
For Islamic marriages conducted overseas, a marriage certificate issued under the Law of that country must be produced to be formally recognised in the UK.
