Are prenuptial agreements binding and when can they be enforced?

Prenuptial agreements are frequently enforced by the courts, as long as the prenuptial agreement has been properly drawn up and they can see that it will not lead to an unfair result. There is a level of discretion provided by the courts when dealing with family law, as no two cases are the same, so there is no guarantee that a prenuptial agreement will be upheld by the court.
