FAQ: Do you have to go to Court during a divorce in the UK?

This will depend on your situation and the dynamics between you and your ex. However, for the majority of divorce cases, court is not necessary. With the introduction of an online divorce application, the need for couples to appear in court looks to be cut even further, but there are some instances where going to court is necessary. These include:

  • Contested divorce – Should your partner want to defend the divorce, or try to block the divorce in any way, then the matter will have to be considered by the courts who will make a decision to grant your divorce or not.
  • Settle financial matters – If the divorce itself goes smoothly, but there arises a dispute with regards to the financial settlement, you will probably  have to issue an application to the court. This could involve high net worth assets, pensions or financial entitlements.
  • Child custody – When children are involved, settling custody rights can often create the most friction between a couple. If an agreement can’t be made – either independently or through mediation, then a court hearing will be required to settle the future custody and child maintenance arrangements.
