FAQ: Mediation vs court proceedings during divorce in England

Mediation involves a trained, independent third party who is there to assist both parties in trying to reach a resolution to their dispute. This is a voluntary process which is often but not always appropriate. Court proceedings are far more formal and they provide a structured timeframe for both parties to work towards in achieving a resolution of their dispute. Mediation is still an option, even where proceedings have been issued.
