FAQ: What is a Cohabitation Agreement?

A Cohabitation Agreement is a legal agreement that is reached by a couple who have agreed to live together. For certain aspects of life, the couple may be treated like a married couple (e.g. child support or mortgages), but in some areas, such as property, pensions and insurance, they are treated differently. The agreement itself is designed to protect couples from any unnecessary legal proceedings should their cohabitation breakdown. The agreement allows them to clearly set out what should happen to assets or what financial agreements need to be put in place in the event of a separation.
