We explain your rights in relation to the estate of a former partner who has previously supported you financially. If that person has not made reasonable provision for you under the terms of their Will, we apply to the Court for proper provision to be made for you. If a former spouse or partner who has previously supported you financially dies without making reasonable provision for you under the terms of their Will, you have the right to apply to the Court to alter the terms of any relevant Will and receive money from the deceased’s estate. In most cases, the legal proceedings required to establish the claim are made through the family Court system and under the same principles.
